Question by pooldawg73: Does a warranty deed for vacant real estate hold title to the property?
I was offered a chance to buy property from an elderly relative of mine. He has a warranty deed and the property next to that belongs to my Aunt, who also has a warranty deed. The map at the court house does not show the same as both of the warranty deeds. The nerighboring property owners have crossed their survey lines right over my two relatives. Can this be legal. Or can the property be lost. Both my relatives have paid their property taxes according to thier deeds. Who owns the property. New Mexico is the state.

have the property surveyed and marked and tell the encroaching property owners to move their stuff or go to court.

Whoevers name is on the deed, is the owner of that property, within it?s boundaries.
